By accessing or using AutoVod ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

You must also abide YouTube's Terms of Service when using AutoVod's YouTube integration.

2. Description of Service

AutoVod provides automated YouTube video upload and management services. The Service integrates with YouTube via Google OAuth to facilitate video uploads on behalf of users.

3. User Accounts and Subscriptions

• You must provide accurate information when creating an account
• You are responsible for maintaining the security of your account credentials
• Usage is limited as specified in the Service
• Users exceeding usage limits must subscribe to a paid plan to continue using the Service

4. YouTube Integration and User Responsibilities

• By using the Service, you authorize us to access your YouTube account via Google OAuth
• You must comply with YouTube's Terms of Service and Community Guidelines
• You are solely responsible for all content you upload through the Service
• You represent that you have all necessary rights and permissions for content you upload
• You must not upload copyrighted content without proper authorization

5. Prohibited Uses and Service Abuse

You agree not to:

• Upload illegal, harmful, or infringing content
• Attempt to circumvent usage limits or access controls
• Conduct denial-of-service (DOS) attacks or similar disruptive activities
• Reverse engineer, hack, or attempt unauthorized access to the Service
• Use the Service for spam, harassment, or other abusive purposes

WARNING: Abuse of the Service, including but not limited to DOS attacks, attempts to evade usage limits, or other unauthorized activities, will result in immediate account termination and may result in legal action.

6. Service Availability and Modifications

• The Service is provided "as is" without guarantees of uptime or availability
• We reserve the right to modify, suspend, or discontinue the Service at any time
• We may perform maintenance that temporarily interrupts service
• We are not responsible for YouTube API changes, outages, or policy modifications

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
• WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM
• WE DISCLAIM ALL WARRANTIES REGARDING FUNCTIONALITY, ACCURACY, OR FITNESS FOR PURPOSE

8. Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload through the Service

9. Account Termination

We may suspend or terminate your account immediately if you:

• Violate these Terms
• Engage in prohibited uses or service abuse
• Fail to pay subscription fees
• Use the Service in a manner that could harm us or other users

10. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated by reference into these Terms.

11. Intellectual Property

• The Service and its content are our property or that of our licensors
• You retain ownership of content you upload, but grant us necessary licenses to provide the Service
• You may not copy, distribute, or create derivative works from the Service

12. Governing Law and Disputes

• These Terms are governed by the laws of England and Wales
• Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales
• You agree to resolve disputes through binding arbitration if required by applicable consumer protection laws
